Revocation of Authorisation for Entry of Orders

The holder files the order with one of the KDD members, who maintains the holder's account (the holder's registry member) on the basis of a contract for dematerialised securities account maintenance

A securities account is regulated by Article 17 of DSA, which stipulates that a securities account constitutes the securities of a holder, where the property relationship is the same and in respect of which the same authorisation exists for entry of orders for transfer of securities to another securities account. 

The authorisation for entry of orders is the same when the holder authorises the same KDD member on the basis of a contract for dematerialised securities account maintenance or stockbroking agreement or another legal transaction. 

A holder may revoke the authorisation at any time, in accordance with the general principles of law of obligations. He may revoke it in the following two manners: 

  • by authorising another member to maintain his account and to enter orders, or
  • by prior revocation of any authorisation to any KDD member (general revocation resulting in full limitation on disposal of securities). 

In the first case a holder revokes the authorisation, given to the member with whom he has been in a contractual relationship, and concludes a new contract for account maintenance with another member. 

In the second case a holder revokes the authorisation to any KDD member for entry of orders for transfer of securities or for entry of third-party rights on securities. Securities on which the revocation of authorisation for entry of orders is recorded cannot be transferred to another account and third-party rights cannot be recorded on them. 

A holder files an application for recording a revocation of authorisation for entry of orders with KDD.

You may deliver a completed and signed application to KDD: 

  • by mail to the address: KDD - Central Securities Clearing Corporation Inc., Ljubljana, Tivolska 48, Ljubljana, or
  • in person to the KDD's post room at the same address during office hours: Monday - Friday from 10:00 a.m. to 12:00 noon, on Wednesday also from 2:00 p.m. to 3:30 p.m. 

Applications via electronic mail are not accepted to avoid possible misappropriation. 

A copy of valid holder's identity document shall be attached to the application. 

A holder may decide to cancel the revocation of authorisation for entry of orders. The application for recording of cancellation of authorisation for entry of orders shall also be filed with KDD.

A holder may only deliver a completed and signed application to KDD in person at the KDD's post room during office hours. He identifies himself with a valid identity document. If the holder cannot come to KDD's post room in person, the application for cancellation of revocation of authorisation for entry of orders may be filed by his proxy, who shows his power of attorney bearing the holder's certified signature and his valid identity document.
