Conditions for access to KDD services by financial institutions/system members in resolution

 

Conditions for access to KDD services by financial institutions/system members in resolution are generally defined in KDD Operations Rules – provisions define:

  1. that KDD requires from a system member a transparent and immediate exchange of information;

  2. that KDD requires from a system member to maintain its operational capabilities and capacities regarding the fulfilment of obligations arising out of its dealings with KDD and other system members;

  3. that KDD requires from a system member to inform them of any circumstances that may endanger the fulfilment of their obligations;

  4. that the resolution procedure of a KDD system member does not in itself prevent access to KDD services;

  5. that KDD may at its own discretion and to the appropriate extent temporarily restrict or deny access of a system member to KDD services (partial or total access restriction);

  6. that, pursuant to Article 16 of KDD Operations Rules, KDD may in the event of a system member undergoing an insolvency procedure, temporarily suspend its access to the information system;

  7. that KDD will take action against a system member if a system member’s resolution procedure (may) endanger the fulfilment of its obligations, whereby KDD shall take into consideration the general policy that each action taken should increase the likelihood of continued and compliant system membership at KDD;

  8. that KDD has defined procedures in place that facilitate the resolution process which also allows for the acquirer in the resolution procedure (‘bridge institution’).
